The Canberra construction firm ordered to pay an injured contractor $800,000 for an injury in 2005, has won their appeal against the payout.
The incident occured in 2005 when the contractor injured his back while moing concrete in a suburban driveway. The man was awarded the payout in 2013.
The key element in the case was whether the company breached its duty of care during the incident, given that the man was an independent contractor. The court has ruled it did not.
Any money paid out will therefore have to be paid back.
